Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. Description of the Service
GISDeploy lets you upload geospatial files (such as GeoTIFFs, Shapefiles, and File Geodatabases) and publish them as interactive maps and standards-based map services (including WMS, WMTS, and WFS endpoints), shareable links, and embeddable viewers. Features and limits vary by plan and may change over time.
3. Nature of the Service
GISDeploy is a self-service software platform provided by Aquedra SpA. The Service is delivered automatically through the website and does not include human-driven professional services, consulting, custom development, manual implementation, or managed services as part of the standard purchase.
You are responsible for configuring and using the platform according to your own needs. Any support provided is limited to general technical assistance related to the use of the software and does not constitute consulting, engineering services, or custom project delivery.
4. Eligibility & Accounts
- You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
- You must provide accurate account information and keep it up to date.
- You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.
5. Plans, Billing & Payment
- The Service is offered under a free plan and paid subscription plans. Paid plans are billed in advance on a recurring (monthly) basis and renew automatically until cancelled.
- Paid plans may include a one-time free trial (currently 14 days) on your first subscription. A payment method is required to start the trial; the first charge occurs automatically when the trial ends unless you cancel before that date. Trials are limited to one per customer.
- Prices are stated exclusive of taxes; you are responsible for any applicable taxes, duties, or levies. We may change prices or plan features with reasonable prior notice, effective at your next billing cycle.
- You can cancel at any time; cancellation stops future renewals and you keep access until the end of the current paid period. Refunds are governed by our Refund Policy.
- Plan limits (projects, layers, storage, and similar) are enforced by the Service, and we may decline operations that would exceed them.
6. Your Content & Data
You retain all ownership of the data, files, and content you upload (“Your Content”). You grant GISDeploy a worldwide, non-exclusive, royalty-free license to host, store, process, transform, transmit, and display Your Content solely as needed to operate and provide the Service — including generating map tiles and WMS/WMTS/WFS services, previews, and, where you mark a dataset as public, serving it through public links and embeds.
- You represent and warrant that you own or have the necessary rights and permissions to upload Your Content and to grant the license above, and that Your Content does not infringe or violate any third-party rights or applicable law.
- You control visibility. Datasets marked “public” may be accessed by anyone with the link or embed; datasets marked “private” require authentication.
- You are responsible for maintaining your own backups of Your Content.
7. Acceptable Use
You agree not to:
- Upload or publish content that is illegal, infringing, defamatory, or that you lack rights to distribute;
- Violate the privacy or intellectual property rights of others;
- Attempt to gain unauthorized access to the Service, other accounts, or related systems;
- Interfere with, disrupt, overload, or abuse the Service or its infrastructure;
- Reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
- Use the Service to transmit malware or to engage in unlawful, harmful, or fraudulent activity.
8. Intellectual Property
The Service, including its software, design, trademarks, and documentation, is owned by GISDeploy and its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in the Service. These Terms do not grant you any right to use our names or logos without prior written permission.
9. Third-Party Services
The Service relies on third-party providers to deliver certain features — for example, address geocoding (via OpenStreetMap / Nominatim) and AI assistant features (powered by third-party large language model providers). Your use of those features may be subject to the third parties’ terms, and we are not responsible for third-party services. See our Privacy Policy for how data is shared with subprocessors.
10. Service Availability & “As Is”
We work to keep the Service available and reliable, but except where a separate written agreement (such as Enterprise) provides otherwise, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost.
11. Limitation of Liability
To the maximum extent permitted by law, GISDeploy and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amounts you paid to us in the twelve (12) months before the event giving rise to the claim, or USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless GISDeploy and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms or applicable law.
13. Suspension & Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to the Service. Upon termination, your right to use the Service ceases and we may delete Your Content after a reasonable period, subject to the Privacy Policy.
14. Changes to the Terms or Service
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in-app). Your continued use of the Service after changes take effect constitutes acceptance. We may also modify, suspend, or discontinue parts of the Service.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Chile, without regard to its conflict-of-laws rules. The courts of Santiago, Chile will have jurisdiction over any dispute arising out of or relating to these Terms or the Service, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
